LEGISLATURE JOINS SUPREME COURT CASE

(Hagåtña, Guam) –

This morning, the Guam Legislature accepted the Guam Supreme Court’s invitation to participate as the Respondent in the Governor’s case. The Governor asks the Supreme Court to restrict the Legislature’s authority to pass certain laws (In Re: Request of Lourdes A. Leon Guerrero, I Maga'hågan Guåhan, Relative to the Validity and Enforceability of Public Law No. 20-134, Supreme Court Case No. CRQ23-001).

The Committee on Rules adopted a resolution to accept the Supreme Court’s invitation without objection.

The Legislature hired Attorney Mike Phillips of The Law Offices of Phillips & Bordallo, P.C. to represent the Legislature in the Governor’s case.

Rules Committee Chair, Chris Barnett, explained how important it is to have the Legislature be part of any challenge to its authority to pass laws. “I am glad my colleagues agree that an issue as serious as this mandates our response and is addressed by the Legislature.”

Barnett also stated he believed the forefathers who participated in the famous “Walk-out” in 1949 “deserve our respect and as Senators we defend the institution they fought so hard to obtain.”
