Road Safety Reminder for the Week
DRIVING WHILE IMPAIRED
Alcohol and/or drugs impair your judgment. Impaired judgment or good sense affects how you react to sounds and what you see. It is also dangerous to walk in traffic or ride a bicycle while under the influence of alcohol or drugs.
On Guam it is illegal to drive, operate, or otherwise be in control of a motor vehicle while:
- impaired under the influence of alcohol or any controlled substance
- having a Blood Alcohol Concentration (BAC) of 0.08% or higher
- having a BAC of 0.04% or higher if under the age of 21
- having impaired physical or mental abilities caused by inhaling, ingesting, applying, or using any chemical, poison or organic solvent, or any compound, or any combination of these
Should you be convicted of a first violation of driving while impaired, you will be guilty of a misdemeanor and shall be sentenced to:
- incarceration for 48 hours to a year
- a fine of $1,000-$5,000
- probation for up to a year
- a 6-month suspension of your driving privilege
Repeat offenses, causing bodily harm to another person while driving impaired, or driving impaired with children in the vehicle may result in a felony conviction and harsher punishments including:
- longer incarceration terms
- steeper fines
- longer probation terms
- having your license revoked for multiple years
